There has yet to be a landmark legal case about Artificial Intelligence (AI) in documentaries, but that doesn’t mean that there aren’t landmark cases that establish legal precedence for documentary filmmaking. Because the technology is so new but expanding rapidly, there are few standards for how to use AI in nonfiction filmmaking, how to disclose it to partners and audiences, and what documentary filmmakers need to consider before choosing to use AI in their productions.
For this next virtual IDAinsight, Dale Nelson (a partner at Donaldson Califf Perez and previous IP counsel at Warner Bros., who co-wrote “AI Tips for Documentary Filmmakers”) and Jan Bernd Nordemann (attorney and an honorary professor of German and European copyright law at the Humboldt University of Berlin) will present the most recent and impactful case law on AI. The conversation will be moderated by Dr. Aymar Jean “AJ” Escoffery (the Margaret Walker Professor of Communication Studies at Northwestern University). For 10 years, Dr. Escoffery has explored how new technologies have transformed the art of storytelling, production, and distribution. He will guide the discussion, detailing recent AI cases and how they specifically affect nonfiction filmmakers all over the world. Currently, Europe and North America have the most extensive legal frameworks for AI and film, but there will be much to learn as other jurisdictions develop standards and practices for AI use.
